Specht Properties, Inc., issued $34,361 penalty by DEQ for construction stormwater violations at Gresham development

The Oregon Department of Environmental Quality has issued a $34,361 civil penalty to Specht Properties, Inc., for disposing construction stormwater into underground injection control systems not registered to receive construction stormwater; for failing to implement stormwater erosion controls; and for failing to perform visual monitoring inspections. $11,261 of the penalty represents the economic benefit that the company gained by failing to manage erosion and sediment at the site as required by the construction stormwater permit. The violations occurred at the 37.4 acre Gresham Vista Business Park development located on NE 223rd Ave., between SE Stark and NE Glisan, in Gresham, OR. DEQ issued the penalty because failure to implement stormwater erosion controls created the discharge of sediment laden stormwater from the construction site. Sediment laden stormwater discharges may negatively impact downstream habitat and water quality. Further, disposal of construction stormwater through UICs may negatively impact groundwater resources.
