DEQ issues $4,307 penalty to Milwaukie gas station for violations

The Oregon Department of Environmental Quality has issued a $4,307 civil penalty to Delco Petroleum Co., LLC for failure to maintain pollution control equipment and for failing to keep required records, including maintenance records and total monthly gasoline throughput records, for the facility located 17873 SE McLoughlin Blvd., Portland, OR. DEQ also cited Delco, without penalty, for failing to test pollution control equipment and keep related records and for failing to maintain spill containment buckets at one of its gasoline underground storage tanks. DEQ issued the penalty because defective or worn vapor balance and vapor recovery equipment may lead to gasoline vapor escaping on gasoline delivery to the facility, or to station customers. These requirements exist because gasoline vapors contain benzene, a known cancer-causing chemical. Maintaining and testing vapor balance and vapor recovery equipment is required by the facility’s permit, and contributes to the continuing compliance with federal ozone standards, and protection of public health and the environment.
