DEQ fines owner for underground storage tank violations

The Oregon Department of Environmental Quality has fined Karen Frackowiak of Canby $1,300 for failing to comply with an order to provide documents to DEQ regarding an underground storage tank system in Woodburn. In June, DEQ fined Frackowiak $1,959 for underground storage tank violations at a property she owns off Grant Street in Woodburn. Frackowiak acquired the property in June 2017. Within 60 days of a change of ownership, owners are required to submit an application for a registration certificate. Additionally, the petroleum tanks are equipped with a corrosion protection system. Such systems must be inspected and tested at least every three years. The last inspection and test occurred in 2006. The June order required Frackowiak to provide documentation to DEQ including a complete application to modify the registration certificate, the results of the corrosion protection system’s inspection and test, and related fees. Frackowiak has failed to provide the documentation and fees to DEQ. Such regulations are in place to safeguard against leaks that can harm the environment and threaten human health. Frackowiak has until Sept. 30 to appeal the latest penalty.
