NOTICE OF EMERGENCY EXEMPTION TO MAXIMUM WORKING HOURS IN CERTAIN MANUFACTURING ESTABLISHMENTS

This notice informs the Bureau of Labor and Industries that the employer identified below claims an exemption to the restrictions on maximum workweek hours on the basis of the Emergency Temporary OAR 839-001-0126 – Emergency Exemption to Maximum Working Hours in Certain Manufacturing Establishments due to the 2020 Coronavirus Pandemic.

This rule interprets ORS 652.020(6)(d), OAR 839-001-0125(1)(f), and OAR 839-001-0125(2) which provide an exemption for maximum hours in certain manufacturing establishments as defined in ORS 652.020(1)(c) in which an employee is engaged in making necessary repairs or in the case of emergency where life or property is in imminent danger.

I/we understand that under this exemption I/we may request employees to work overtime in excess of the hours prescribed by ORS 652.020, but not more than 13 hours per day and 91 hours per week, during the emergency exemption period. I/we will continue to pay employees overtime at the rate of one and one-half times the regular rate of pay for hours worked in excess of 40 hours of work in one workweek as required by ORS 653.261(1)(a). I/we have emailed a copy of my/our social distancing protocols as required by Governor Kate Brown’s Executive Order 20-12 to whdscreener@boli.state.or.us. I/we have compiled consent forms from all workers who have agreed to work overtime in excess of 55 hours per week during this emergency exemption period
